Over the past couple of months there have been a number of significant decisions.  The ones that will be highlighted in this edition of the Employment Law update include:

  1.   Supreme Court of Canada’s decision on prima facie discrimination and the duty to accommodate;
  2.   3 decisions from the BC Court of Appeal, concerning a variety of subjects including awards of aggravated damages in tort claims, awards of aggravated damages based on mental distress    arising out of wrongful dismissal and the legal test for just cause;
  3.   3 decisions from the BC Supreme Court, considering application of the test for “dependent contactor”, awards of aggravated damages, termination during probationary periods of    employment and awards of damages relating to mitigation efforts.
