There were four decisions of note since my last Employment Law update. These cases considered the following:
- Recognition of “Dependent Contractor” status;
- Analysis of the doctrine of revelation of character as constituting just cause for dismissal;
- Use of the Rules of Court to strike various allegations in the Notice of Civil Claim;
- Judicial review of a human rights decision – this decision included a summary of the standard of review, the admissibility of opinion evidence, the test for prima facie discrimination and the test for bona fide and reasonable justification for the denial of service.
